SkyWalking V2 Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the iOS application "SkyWalking V2" (the "App") provided by the developer of SkyWalking V2 (the "Developer"). By using the App, you are deemed to have agreed to these Terms.
1. About the App
- The App is a GPS logging app for outdoor activities, providing GPS track recording, map display, GPX file management, offline map storage and related features.
- In the free version, there are limits on the number of GPX files and offline maps that can be saved. The details of these limits follow what is shown in the App.
- Features may change without notice as the App is improved.
2. Subscription (SkyWalking V2 Pro)
- The App offers a paid auto-renewing subscription, "SkyWalking V2 Pro" (monthly or yearly plan). Subscribing removes the limits on the number of saved GPX files and offline maps.
- Prices follow what is displayed on the App Store.
- Subscription fees are charged to your Apple account when the purchase is confirmed.
- If a free trial period is offered, billing starts automatically at the end of the trial unless you cancel before it ends.
- The subscription renews automatically and the renewal fee is charged unless you cancel at least 24 hours before the end of the current period.
- You can cancel at any time from the device's Settings app → Apple Account → Subscriptions. Cancellation is not possible from within the App.
- After cancellation, you can continue to use the subscription benefits until the end of the period you have already paid for. No pro-rated refunds are provided (refund eligibility follows Apple's policies).
- When changing devices or reinstalling, you can restore your subscription with the same Apple account using "Restore Purchases" in the App.
3. Free Version Limits and Your Data
- When you reach the free version's storage limits, you cannot save new data, but data you have already saved is never deleted automatically.
- GPX export (writing data out of the App) is available at any time, in both the free version and the subscription.
- Recorded data is stored on your device. To protect against data loss from device loss, failure or App deletion, please back up important data yourself, for example via GPX export.
4. Map Data
- Some of the map tiles and elevation data displayed by the App are provided by the Geospatial Information Authority of Japan (GSI). Attribution is shown on the map. The content and availability of map data depend on GSI, and the Developer does not guarantee its accuracy or continued availability.
- When Apple Maps is displayed, Apple's terms of use apply.
5. Disclaimer
- Positions, elevations, distances and other values displayed or recorded by the App are estimates based on GPS and similar positioning technologies, and their accuracy and completeness are not guaranteed.
- The App does not guarantee your safety in mountaineering or other outdoor activities. You are responsible for your own safety, including checking weather conditions, preparing maps and equipment, and planning within your abilities. The App is not a substitute for paper maps, a compass or other navigation tools.
- The App's features (recording, map display, etc.) may be unavailable depending on network conditions, battery level, OS behavior and other factors.
- The Developer is not liable for any damages arising from use of, or inability to use, the App, except in cases of willful misconduct or gross negligence by the Developer.
6. Prohibited Conduct
You must not do any of the following:
- Reverse engineer, decompile or disassemble the App (except where permitted by law)
- Redistribute, sell or lend the App
- Infringe the rights of the App or of third parties (including map data providers)
- Act in violation of laws or public order and morals
7. Intellectual Property
Intellectual property rights in the App and related content (excluding third-party materials such as map data) belong to the Developer.
8. Changes to the Terms
The Developer may change these Terms as necessary. Significant changes will be announced on this page or within the App. By continuing to use the App after a change, you are deemed to have agreed to the revised Terms.
9. Governing Law
These Terms are governed by the laws of Japan, and any dispute concerning the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Developer's location.
